I live in New Hampshire my kids father lied and manipulated the situation with custody in order to move our kids to Massachusetts. Refuses to co-parent and cut off contact completely in August. 

My ex and I separated in the summer of 2017. He left after an altercation taking our toddlers car seats with him so I would not be Able to leave the house. When he tried to come home, I prevented him from doing so. In retaliation, he filed an ex parte claiming I abused my kids and him. The police showed up at my house and took my kids. They explained the court order to me, and even though I was mad/sad/scared I calmly got the kids belongings together and told them they were going to see their dad. They hadn't seen him in almost 2 weeks so they were excited. Prior to this any time I had asked their father Kyle, if he wanted to see the kids or take them for the day or weekend, he declined. 

The day after the police removed my kids from my custody, I went to the court house and filed a motion to have the custody hearing expedited. It was granted and a week later we were in court. 

Kyle immediately went into a confusing description of who I was as a parent, with basically the worst thing he could say about me was that I yelled alot. 

When it was my turn, Kyle made several attempts to cut me off, after 3 warnings he stopped. I carefully explained the end of our relationship, a little about the relationship, and how kyle refused to see the kids prior to the police involvement. It seemed pretty clear to me that he wasn't really afraid for the kids safety.

Judge asks kyle about the allegations he made, more specifically, about the claims of abuse. His only response was that I told him that I did not love him while the kids were present. The judge was clearly annoyed. He asked Kyle what he thought should happen if he was to keep the order as it was as far as visitation with me the kids. Kyle immediately replied that he did not want me to have any contact with the kids until I had a "psychic evaluation." When asked the same question I could not holdback the tears any more and begged the judge to please allow me to have visitation with my babies because that week was the longest we had ever been separated. The judge asked Kyle to leave, and me to stay. When he was gone, the judge told me he would be reversing the order and granting me sole physical custody until we had a custody hearing and spoke with a mediator. He advised me to petition the court asap and start talking to a mediator because it was clear kyle intended to hurt me with the kids.

When I went to pick the kids up, kyle refused to give them to me, even dragging my daughter away from the sliding glass door she could see me through by her ankle. I went to the police station with the court order in hand. Apparently there was some other emergency, so I was unable to get a police escort back to Kyle's mom's house where the kids were, and had to wait at the end of the driveway until am officer arrived.

Four hours later an officer arrives, goes to explain to kyle that the judge signed off, and if he continues to keep the kids, he would be arrested. Kyle relinquished the kids but refused to give me their clothes or car seats. The officer said he could not establish custody of the items so it was a civil matter. I was just happy to have my kids.

Soon after this I realized that Kyle had not fulfilled his role In the family, which was to make sure the bills were paid, while I took care of the upkeep, laundry, meals, kids, my disabled father, baby sitting, and school. As a stay at home parent I could not afford to pay the over due bills, nor could I keep up with the new bills. I requested state and town help from the welfare departments, but my landlord would not sign the forms. I discovered later that Kyle had made an agreement with the landlord that if he went through with evicting me, Kyle would pay the past due amount in cash.

I did not know that I could get more time fighting the eviction, and the day before the sheriff came to evict my kids and I, I had no choice but to bring the kids to their dads house. This was the first time he had seen them since the reversal of the court order, and had only agreed to take them for the weekend. I knew I had no where to bring them so I had no choice.

Over the next few months I lived with my boyfriend, and we were working toward getting a place so I could get the kids back. I got my license, and a job and things seemed to be going ok. I was seeing the kids regularly, until my ex clearned out our joint bank account to maintain his drug habit I thought he was on MAT for. I lost my place to live, my vehicle, my job. I had struggled with alcoholism before This, and fell back into it.

The next 3 years I was battling undiagnosed mental illnesses, undiagnosed personality disorder, and my alcoholism, eventually turned into an opiate addiction. Regardless of this my kids were always safe when they were with me, cared for, ate nutritious meals, they were clean, well dressed and nurtured. 

Kyle on the other hand was living with his mother. He never made good on the deal he made with the landlord. He was drinking heavily and ended up totalling his Jeep with both of our children and his older son from a previous relationship. He never told me about this until very recently.

 Kyle and I promised to keep our custody agreement out of court. I was genuine when I said I felt it was our responsibility to figure things out like adults because we made the kids. Kyle agreed but only so he could petition the court against my knowledge. He knew the address of where I was living, yet claimed he did not. Then when I expressed a desire to get treatment and mental health counseling he was very encouraging and supportive. I went to georgia to get out of the environment o was in, and Kyle immediately moved the kids to Massachusetts.

It's been about a year, but I have finally managed to get myself together. In a MAT program, in counseling for my addiction, as well as my mental health, and I managed to get off the street completely on my own.

Since living in MA Kyle moved the kids in with his girlfriend. This was something that made me feel at ease at one time because my daughter loved her. Over the summer that changed

 I don't know the details but I know Kyle moved himself and the kids out of the house he shared with his girlfriend, due to her behavior toward the kids. She was being overly cruel to them, ridiculing them, making derogatory remarks about me, unfairly punishing them, and who knows what else.

In August it came to my attention they had moved back in with the girlfriend. Kyle claims she only acted that way due to her father dying, but my daughter told me she was afraid of her. She wanted to tell me something, but knew her dad would be angry if he heard. When she thought the coast was clear she began to tell me. Out of nowhere the line went dead. 

I called back to Kyle being very combative, telling me that he hates me, and I have no right to pass judgement on his house. He told me I would not be allowed to see the kids or speak to them until I went to court. Despite the following day being my daughter's 6th birthday, and Kyle had told her the year before I could go, only to change his mind last moment just as he was doing once again. The year prior, my daughter didn't even participate in her own laety because she was waiting for me to get there on the porch.

I drove to Gloucester the following day with my mother hoping they were having the party at an address Kyle had given me to send the kids presents. They were not at that address. I haven't seen or spoken to my kids since August.

Both of my children openly speak about how they want to live with me. They tell me how their dad gets mad when they cry for me or my son has a bad dream. My son thinks his dad hates him because he is interested in barbies and my little pony. The kids are only fed chicken nuggets, mac and cheese, spaghetti, and their clothes don't fit, they are often dirty. My son's hair is never maintained, and Kyle says he wants to give him dread locks despite the fact my son adamantly objects to this.

Kyle's oldest son was abandoned by his mother after moving back to the US from Trinidad. He has always had issues with being cruel and inappropriate with my kids. He tells my kids ghxt I am dead whenever Kyle goes on his little cut Paige out tangents. Kaleb, Kyle's son also tells my kids I don't want them. He terrorizes them, and Kyle either never disciplines him, or will go way overboard.

I don't want to take my kids from their father for good, but I strongly believe they would be much better off, and happier with me. What should I do?

He established sole custody in NH, I don't know what he has done in the court so far in massachusetts.
